Affiliate Program Agreement

This Affiliate Program Agreement ("Agreement") governs your participation in the Live Lead Extractor affiliate program, operated by Crush It Media Group LLC, doing business as Live Lead Extractor ("Live Lead Extractor," "we," "us," "our," or the "Company"). By enrolling, you accept these terms electronically. This Agreement incorporates our Terms of Service, Acceptable Use Policy, and Privacy Policy.
1. The relationship
You are an independent contractor — not an employee, partner, or agent of the Company. You have no authority to bind the Company. You are solely responsible for your own taxes.
2. Commission
The Company pays 25% of the net purchase price on each qualified sale by a customer you referred, on their first payment and every subsequent renewal or purchase, for the life of the referred account (for as long as they remain attributed to you). "Net" excludes taxes, fees, refunds, and chargebacks. Self-referrals do not qualify. Rates may change prospectively on notice; changes never affect commissions already earned.
3. Attribution and tracking
Attribution is last-click and is locked in when the referred customer creates their account: the customer is bound to the affiliate whose referral link was most recently stored in their browser at the time of signup. Once set at signup, attribution is permanent for the life of that account — it does not change if the customer later clicks a different affiliate's link. Self-referrals do not qualify. Attribution depends on the visitor's browser storage, which can be blocked or cleared; the Company's tracking records are the sole and final basis for commissions, and un-trackable referrals are not the Company's responsibility.
4. Payments
Commissions are paid once your cleared balance reaches $50, after a 30-day hold during which the sale must remain non-refunded. Payouts are made via Stripe to the payout account you connect; Stripe collects and holds your banking and tax details directly — we never store them. Refunds, chargebacks, or fraud reverse the related commission, which may be deducted from future payouts.
5. Taxes
U.S. affiliates must submit a W-9 before payment; the Company issues Form 1099-NEC where required (generally $600+/year). Non-U.S. affiliates submit W-8BEN/W-8BEN-E. You acknowledge your promotion may create tax nexus obligations and will provide information reasonably requested to comply.
6. FTC and advertising compliance
You must comply with the FTC Act and the Endorsement Guides (16 CFR Part 255). On every platform, clearly and conspicuously disclose that you earn a commission, near your link — not buried. All claims must be truthful, non-misleading, and substantiated. You must comply with CAN-SPAM (email), the TCPA (SMS/calls), and applicable privacy laws.
7. Prohibited practices
No spam; no bidding on the Company's trademarks or brand terms in paid search; no cookie stuffing, forced clicks, or deceptive tracking; no self-referrals or fraudulent orders; no unauthorized coupons/cashback; no false earnings claims; no promotion on illegal, adult, or infringing sites; no impersonation of the Company; no domains or handles containing our marks. Violations may forfeit commissions and terminate your account.
8. Trademark license
The Company grants a limited, non-exclusive, revocable license to use approved names, logos, and assets solely to promote the Company. You gain no ownership; all goodwill inures to the Company.
9. Term and termination
At-will — either party may end this Agreement at any time, with or without notice. On termination you must remove your links and our marks. Earned, cleared commissions remain payable unless termination is for breach or fraud.
10. Disclaimers and liability
The program is provided "as is" with no guarantee of earnings, sales, or continuity. To the extent permitted by law, the Company is not liable for indirect or consequential damages, and its total liability will not exceed commissions paid to you in the prior 6 months. You indemnify the Company against claims arising from your promotion, content, or breach.
11. Governing law
This Agreement is governed by the laws of the State of Florida. Venue lies in the state and federal courts located in Hillsborough County, Florida (Tampa). The Company may update these terms prospectively; continued participation constitutes acceptance.
